Dear Mr Lancaster,
I have met with constituent Mr Olmec Sinclair of 99 Huntsbury Ave Christchurch with regard to a subdivision he is proposing to purchase at Milmore Downs Ltd- 299P Overton's Road, Scargill. (This is a family subdivision, Mr Sinclair's grandfather was a previous owner and the current owner is his uncle.)
According to Mr Sinclair the subdivision in question is bisected by the Main North Railway and there is a rail crossing on the section (Crossing 89.9km MNL).
Mr Sinclair has three questions that I ask on his behalf:
- Is the crossing in question a statutory crossing?
- If so what are the rules and obligations to the landowner of such a crossing?
- Can Ontrack impose a Deed of Grant on this sub-division and if so, what is the legal basis for this?
